Important information for applicants

It is an offence under the Working with Children Act 2005 ('the Act') to:

  • do child-related work without a Working with Children Check:
    • unless you are exempt and have not been given a Negative Notice.
    • unless you have applied for a Check and not been charged with, convicted or found guilty of a sexual, violent or drug offence listed in Schedule 3 of the Act.
  • apply if you are registered under the Sex Offenders Registration Act 2004, or subject to an order under the Serious Sex Offenders Monitoring Act 2005 or Serious Sex Offenders Detention and Supervision) Act 2009
  • provide false or misleading information.



Can I work while my application is processed?

Before you can start child-related work, give your organisation your application number, so it can verify that under the Act you are eligible to start this wok.

You cannot do child-related work whilst your application is processed if you have:

  • been charged with, convicted or found guilty of a sexual, violent or drug offence listed in Schedule 3 of the Act
  • previously failed the Check, been issued with a Negative Notice and not subsequently been given a card.

You cannot work with children until you pass the Check if you:

  • supervise a child employee
  • work under the Children's Services Act 1996 or Education and Care Services National Law (Victoria) Act 2010.



Keeping your details up to date

By law, you must let the Department of Justice and Community Safety know within 21 days of changes to your details. Fore example, moving house or starting child-related work with a different organisation. Once you receive an email with your receipt, you can register for MyCheck and update your details anytime online.




The Department of Justice and Community Safety will only use the information obtained through Checks as permitted by the Working with Children Act 2005Privacy and Data Protection Act 2014 and Health Records Act 2001.

If you have a criminal record, the department will not disclose the details to your organisation without your consent.
